Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using any part of myBRANDbldr, you confirm that you are at least 13 years of age (or have parental/guardian consent if under 18), and that you agree to these Terms and our Privacy & SMS Policy. If you do not agree, please do not use the Platform.

2. Description of Service

myBRANDbldr provides a suite of AI-powered tools designed to help users:

• Plan, create, and schedule content across social media platforms
• Build and maintain a consistent personal brand identity
• Track growth analytics and engagement metrics
• Access an affiliate marketplace and brand partnerships
• Receive personalized brand coaching through iBld, your AI Brand Navigator

Features vary by subscription tier (Spark, Ignite, Blaze). We reserve the right to modify, suspend, or discontinue any feature at any time with reasonable notice.

3. Account Registration

To use myBRANDbldr, you must create an account and provide accurate, complete information. You are responsible for:

• Keeping your login credentials secure and confidential
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use at hello@mybrandbldr.com

We reserve the right to suspend or terminate accounts that violate these Terms or that we believe have been compromised.

4. Subscription Plans & Billing

myBRANDbldr offers the following subscription tiers:

• Spark — Free tier with core branding tools and limited AI credits
• Ignite — Paid monthly/annual tier with expanded AI features, scheduling, and analytics
• Blaze — Premium tier with full access, priority support, affiliate marketplace, and advanced automation

All paid subscriptions are billed in advance on a monthly or annual basis. Early adopters who join during the launch period lock in 50% off — for life. Prices are subject to change for new subscribers with 30 days notice. Refunds are issued at our discretion within 7 days of initial purchase for first-time subscribers.

5. User Content & Intellectual Property

You retain full ownership of all content you create, upload, or share through myBRANDbldr (“User Content”). By using the Platform, you grant myBRANDbldr a limited, non-exclusive, royalty-free license to process, display, and distribute your User Content solely as needed to provide the Service.

myBRANDbldr’s brand assets, AI models, platform design, and all proprietary technology are owned by myBRANDbldr LLC and may not be copied, modified, or redistributed without express written permission.

6. AI-Generated Content & iBld

iBld is your AI Brand Navigator — built to learn your voice, guide your strategy, and help automate content creation. Please be aware:

• AI-generated content is a starting point. Always review and edit before publishing.
• myBRANDbldr does not guarantee the accuracy, originality, or fitness of AI-generated content for any specific purpose.
• You are solely responsible for content you publish using AI-assisted tools.
• Do not use iBld to generate content that is misleading, defamatory, or in violation of any third-party rights.

7. Acceptable Use Policy

You agree NOT to use myBRANDbldr to:

• Violate any applicable local, state, national, or international law or regulation
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Upload or distribute malware, spam, or unauthorized advertising
• Scrape, harvest, or mine data from the Platform without our written consent
• Interfere with or disrupt the integrity or performance of the Platform
• Use the Platform to promote hate speech, harassment, or harmful content

Violations may result in immediate account suspension or termination without refund.

8. Affiliate Program & Marketplace

myBRANDbldr offers an affiliate referral program and brand marketplace (available on Blaze tier). By participating:

• You agree to promote myBRANDbldr honestly and in compliance with FTC disclosure guidelines
• Commissions are paid per the current affiliate program terms, which may be updated from time to time
• myBRANDbldr reserves the right to modify commission structures with 30 days notice
• Fraudulent referrals or self-referrals will result in forfeiture of commissions and account termination

9. Privacy & Data

Your privacy matters to us. Our Privacy & SMS Policy explains how we collect, use, and protect your personal information. By using myBRANDbldr, you consent to the data practices described in that policy, including SMS communications if you opt in during signup.

10. Disclaimers & Limitation of Liability

myBRANDbldr is provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee uninterrupted access, error-free performance, or specific business outcomes from using the Platform.

To the maximum extent permitted by law, myBRANDbldr’s total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the three (3) months preceding the claim.

11. Termination

You may cancel your account at any time through your account settings. myBRANDbldr reserves the right to suspend or terminate your account for violations of these Terms, non-payment, or at our discretion with notice. Upon termination, your access to the Platform and your data will be handled per our Privacy Policy data retention procedures.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we’ll update the “Last Updated” date above and, for material changes, notify you via email or in-app notification. Your continued use of myBRANDbldr after changes take effect constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Maryland, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts located in Montgomery County, Maryland.
